Sun Aug 15, 2004 1:42 pm Purple Rain - Live, performed by me, |
|
howdy folks.
is it me or there hasn't been any new music posted?
anyways, came back from Egypt on thursday, and while i was there i was asked to play guitar for them.........sigh...who'd be a musician eh?
fortunately i had my guitar, my USB interface, My external Hard drive & My dell inspiron, and some handy software!
so, here's me playing Princes "Purple Rain", live in stupid heat at the ramada hotels terrace while people were enjoying a buffet ehehe.
i played afew other things that i might post later.
enjoy :0)
sorry about the quality it was dark, and i had to filter it out to get it to look and sound good, plus i had to resample it to fit it here and make it downloadedable for all the non-broadbanders........ain't i a thoughtful guy  )

Dave... now I have the black Pete
I have deleted your attachment because we can't support the presentation of copyright protected material here like cover versions of hits like "Purple Rain" by Prince.
IC-Musicmedia will have to pay royalties for this kind of "broadcasting".
If you want to share copyrighted material get yourself a license and pay for it
Furthermore.... do not upload compressed files like in *.rar or *.zip format when trying to share MP3's or JPG's.
Both file formats are already compressed formats and you will not gain more than 3 or 5 bytes by compressing them again. Also Mac- or Linux users may have problems opening PC/Windows based files packed with RAR or ZIP file compressors. |

mike, it was a wmv, not an mp3.............video clip...........
in relation to the licensing, i thought i wasn't needed. i know prince had problems with his label (was it warner? i think) about royalties and licensing and had legal crap with them.
and it's not broadcast for money, it's free, and i wasn;t paid for the performance,so from what i know, no licensing is required.
feel free to correct me. |

You have uploaded a *.rar compressed file.
I even did not look any further as it is the same with the *.wmv format.
You can't compress already compressed file formats.
Regarding the licensing of cover versions....
You are NOT correct and I'm no party pooper.
The music of "Prince" is copyrighted.
If you want to make any cover version of "Prince" or any other copyrighted artist available anywhere, you'll need to have a paid license or explicit "OK" of the copyright owner in written form.
BTW... if you perform a cover version live on a concert, you are required to pay royalties as well (usually done by club- and hotel-owners themselves in a lumpsum for a year).
Please understand that IC-Musicmedia.com is monitored by performing rights organizations and we already had cases where IC-Musicmedia was "invited" to pay for artists who thought they can upload their versions of Eminem's or Van-Halen's greatest hits.........
Simply present here only your own original material, no cover versions, no samples and no remixes of copyrighted music. |

mike, i compressed the file so it would be smaller then 5 meg.
it went from being 5.57meg to about 4.78 or something, so it does work mike, don't start talking about formats n stuff, i've got experience working in the digital realm (i have a B.A Degree to be exact).
In regards to licensing, i've emailed the appropriate people and am awaiting for a reply. |

hmmm. still no reply regarding licensing.
what if i uploaded the file elsewhere, and posted a link to it?
wouldn't that be okay, because you wouldn't be hosting or be liable for it then.
just a thought

Well, leaving the "degree" theory (I have none HAHAHA) alone... it is a very good idea to promote only original material
It is not my idea that the music industry is penalizing any unauthorised use of copyrighted material, wherever by whomever. |

Dave, no-one can stop you performing any cover song in the world. However if you make a recording of a cover song; to broadcast it; you'd need a licence from the songwriters and/or their publisher. It has nothing to do with record companies, this is a songwriting matter.
Since live music venues pay a yearly license, if you perform your own songs, you can actually claim the royalties (through APRA e.g.). If you perform covers, obviously not as you are not the songwriter. Concert promoters pay a one-off performance licence so you can play covers or originals. However if you RECORD your concert and you are playing a cover in the recording, as mentioned by Mike - you have to have a license to be able to broadcast it.
This may all seem quite silly until you start writing your own songs and expect to make a living from songwriting. Would it then be fair for someone to record and possibly make money from your songs without paying you for the right to do so? Food for thought.
We know you added the link in all innocence. Did you play any of your own songs at the Egyptian buffet? |
